{"id":10450,"date":"2022-09-20T18:29:05","date_gmt":"2022-09-21T00:29:05","guid":{"rendered":"http:\/\/hombresymujeresdelacasa.com\/home\/?p=10450"},"modified":"2022-09-20T18:29:06","modified_gmt":"2022-09-21T00:29:06","slug":"ayer-entro-en-vigor-la-nom-247","status":"publish","type":"post","link":"https:\/\/hombresymujeresdelacasa.com\/home\/ayer-entro-en-vigor-la-nom-247\/","title":{"rendered":"Ayer entr\u00f3 en vigor la NOM 247"},"content":{"rendered":"\n<p>Redacci\u00f3n <\/p>\n\n\n\n<p><em>La Norma busca proteger a los usuarios de publicidad enga\u00f1osa y contratos dolosos en el mercado inmobiliario.<\/em><\/p>\n\n\n\n<p>El 19 de septiembre entr\u00f3 en vigor la Norma Oficial Mexicana NOM 247 SE 2021, que establece reglas para proteger a los usuarios de publicidad enga\u00f1osa y contratos dolosos en operaciones inmobiliarias.<\/p>\n\n\n\n<p>Esta nueva disposici\u00f3n va dirigida a \u201cPr\u00e1cticas comerciales-Requisitos de la informaci\u00f3n comercial y la publicidad de bienes inmuebles destinados a casa habitaci\u00f3n y elementos m\u00ednimos que deben contener los contratos relacionados\u201d, y su objetivo fundamental es proteger al consumidor de posibles fraudes.<\/p>\n\n\n\n<p>La Norma Oficial Mexicana NOM-247-SE-2021 se public\u00f3 en el Diario Oficial de la Federaci\u00f3n el 22 de marzo del 2022, estableciendo su puesta en vigor para el 19 de septiembre del mismo a\u00f1o.<\/p>\n\n\n\n<p>La NOM 247 busca proteger los derechos de los consumidores en la compraventa e intermediaci\u00f3n de inmuebles destinados a casa habitaci\u00f3n y no aplica para el arrendamiento, ni para la administraci\u00f3n de inmuebles.<\/p>\n\n\n\n<p>La Norma tampoco es aplicable para la compraventa de inmuebles comerciales, como oficinas, bodegas, naves o parques industriales, locales comerciales, terrenos comerciales, industriales, hoteles o ranchos, o inclusive de uso habitacional, que a\u00fan no se han subdividido para su venta individualizada.<\/p>\n\n\n\n<p>Es importante destacar que la Ley de Protecci\u00f3n al Consumidor no es nueva, la primera se public\u00f3 el 21 de diciembre de 1975, y la segunda el 24 de diciembre de 1992.<\/p>\n\n\n\n<p>Desde entonces, la disposici\u00f3n y ha sido reformada var\u00edas veces, y ya a partir del 2004 hac\u00eda obligatorio registrar contratos de adhesi\u00f3n; sin embargo, no siempre se ha cumplido con dicha obligaci\u00f3n y ha habido mucha ausencia de informaci\u00f3n en cuanto a su cumplimiento por parte del sector inmobiliario.<\/p>\n\n\n\n<p><a href=\"https:\/\/centrourbano.com\/author\/editorial\/\" rel=\"nofollow noopener\" target=\"_blank\"><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Redacci\u00f3n La Norma busca proteger a los usuarios de publicidad enga\u00f1osa y contratos dolosos en el mercado inmobiliario.
